Air Force Lt. Col. Victor Fehrenbach is not taking his possible discharge from the military sitting down. Fehrenbach, who had served in the Air Force for 19 years, may lose his retirement benefits if the military discharges him before he fulfills 20 years of service. In 2008 the Air Force investigated allegations that Fehrenbach sexually assaulted another man, which would have violated the military's "Don't ask, don't tell policy." Though the charges were dropped, the Air Force investigation continues. Fehrenbach insists that the government cannot prove that his service in any way disrupted "morale, good order and discipline, and unit cohesion." In 2008, a ruling by the U.S. Court of Appeals for the Ninth Circuit maintains that in order for a discharge to occur, the government has to prove that the above had been affected. "Everybody on my base knows my story, and I think everybody in the Air Force knows it,” Fehrenbach said.
