While many states are battling over same-sex marriage, Alabama has only just ruled that prohibiting homosexual sex is unconstitutional. Last Friday, the Alabama Court of Appeals ruled unanimously in the case of Dewayne Williams v. State of Alabama. Williams was convicted of first-degree sodomy in 2010 via language that stated “consent is no defense to a prosecution under this subdivision.” Alabama wanted to remove that line from the law and put Williams on trial again, but the court said no. According to Human Rights Watch, Alabama is one of a dozen states with laws targeting consensual homosexual relations on their record books.
