From a border fence to a legal one: On Thursday, Arizona Republicans introduced new “birthright” legislation, challenging the right to citizenship for kids of immigrants born in the U.S. In effect, the law makers are challenging the 14th amendment of the Constitution, which promises citizenship to "all persons born or naturalized in the United States, and subject to the jurisdiction thereof." Says Rep. John Kavanagh, who backs the bills: The goal is "to trigger ... a Supreme Court review of the phrase 'subject to the jurisdiction thereof' in the 14th amendment.” And more broadly: "to deny citizenship to any child born of parents who are not citizens of the United States, be they illegal aliens, or foreigners on business or for tourist purposes.”
