The Supreme Court is allowing the Don’t Ask, Don’t Tell policy to remain in place while a federal appeals court examines the issue of gays in the military. The court denied the conservative gay group Log Cabin Republicans' request to intervene and overturn the policy. Last month, a federal judge ruled that DADT violated civil rights for gays and lesbians and placed an injunction prohibiting the Pentagon from applying the policy. The policy was lifted for eight days when U.S. District Judge Virginia Phillips also ruled DADT unconstitutional in October. The Obama administration asked the appeals court to maintain the ban until arguments can be heard next year, though the president has said that he plans to repeal the law during the lame-duck session of Congress.
