Now that Suspect No. 2, Dzhokhar A. Tsarnaev, has been captured alive, Sen. Lindsey Graham (R–South Carolina) would like for officials to treat him like an “enemy combatant” and not read him his Miranda rights for “intelligence-gathering purposes.” Graham urged the administration to flout the law in a series of tweets, writing, “The last thing we may want to do is read Boston suspect Miranda Rights telling him to ‘remain silent.’” The Obama administration stopped using the phrase “enemy combatant” in 2009, but still allows broad detainment of anyone suspected of providing “substantial” assistance to al-Qaeda.
