An Albuquerque cop shot and killed a man who fired on officers first, police said Tuesday. The incident comes just one day after Bernalillo County District Attorney Kari Brandenburg said she was seeking murder charges against two officers for the shooting of a homeless man last March. Police were apprehending one man just before 5 p.m. on Tuesday when another man took off on foot. The man allegedly began shooting at the officers before at least one cop returned fire, according to a statement released by a spokeswoman for the Albuquerque Police Department. Police say the man was wearing body armor and his weapon was found near his body. The APD has faced mounting criticism for using excessive force, which resulted in the city and the Justice Department signing an agreement to overhaul the police department.
