The city of Cleveland has responded to a lawsuit filed by the family of Tamir Rice, the 12-year-old boy who was shot to death by a rookie police officer while holding a toy gun. The city deems Rice’s death and the injuries his family endured “directly and proximately caused by their own acts, not this Defendant.” It said that Rice’s death was caused “by the failure…to exercise due care to avoid injury.”
