The FBI has opened an “extremely serious” look into Hillary Clinton’s e-mail server and the “gathering, transmitting or losing defense information” as part of the Espionage Act, according to sources for Fox News. A national security attorney told Fox that violating this part of the Espionage Act could result in a felony. Even though Clinton claims she “never sent nor received any email that was marked classified,” the FBI is seeking to determine if she should have known certain material was classified in nature regardless of the markings. According to a government legal source, the rules and regulations do not hold a “send” or “receive” distinction.
