A mother who abandoned her newborn baby at a nativity scene inside a New York church will not be prosecuted, the Queens district attorney said on Wednesday. District Attorney Richard Brown said in a statement officials determined no criminal prosecution was warranted and the mother "followed the spirit of New York's 'Safe Haven' law." The mother reportedly left the baby, with its umbilical cord still attached, at the church because she knew it would be found and returned the following morning to check and see if the baby was found, according to Brown. New York's Safe Haven law states that a parent can leave a newborn of up to five days old with an appropriate person or in a suitable location where the parent could notify an appropriate person. The child is in protective custody.
