Elena Kagan survived her first day of questioning on Capitol Hill Tuesday, parrying Republican thrusts and trying to present herself as candidate for the Supreme Court with bipartisan appeal. Although she said her political outlook is "generally progressive," Kagan said she supported gun rights and the use of military commissions for enemy combatants. Not completely pleasing conservatives, Kagan said the new health care reform law, which requires people to obtain insurance and is likely to come to the Court's attention, is on sound legal footing. With another hat tip to Republicans, Kagan said she had “the greatest admiration” for conservative Justice Anontin Scalia. Kagan wasn't completely serious, however. When quizzed by Sen. Lindsey Graham about where she was on Christmas Day 2009, Kagan replied, "You know, like all Jews, I was probably at a Chinese restaurant."
