The Obama administration has appealed a federal judge’s injunction against the enforcement of Don’t Ask, Don’t Tell, asking the 9th U.S. Circuit Court of Appeals to reinstate the ban. On Tuesday, District Court Judge Virginia Phillips refused to grant the stay, saying the government had not demonstrated how lifting the ban will hurt troop morale. The Pentagon has advised military recruiters to accept openly gay candidates as long as they are otherwise qualified.
