The release of a man who has spent more than four decades in solitary confinement has been delayed after Louisiana’s top lawyer filed a motion Tuesday to keep him incarcerated. Louisiana Attorney General James D. “Buddy” Caldwell filed an emergency stay motion with the U.S. Court of Appeals for the 5th Circuit to stop Albert Woodfox’s release. On Monday, a judge ordered Woodfox’s unconditional release and barred a third trial after the 68-year-old’s murder conviction had been twice overturned. Woodfox has served 43 years in solitary confinement at the Louisiana State Penitentiary, where he was blamed for the death of a prison guard during a riot. The state now has until Friday to prove why Woodfox should remain in jail
