A federal judge in San Antonio declared Wednesday that Texas's ban on same-sex marriage is unconstitutional because it deprives gays of due process and equal protection under the law. "Without a rational relation to a legitimate governmental purpose, state-imposed inequality can find no refuge in our U.S. Constitution," Judge Orlando Garcia wrote. But the law will remain in place until the state has a chance to appeal. Garcia predicted the case "will make its way to the Supreme Court."
