The American Civil Liberties Union of Wisconsin has filed a suit against the state's same-sex marriage ban along with its extra provision, the “marriage equation law,” which criminalizes “leaving the state to contract a marriage that is prohibited or void.” The lead plaintiffs, Virginia Wolf and Carol Schumacher, got married in Minnesota. Their lawsuit argues that the state is practicing discrimination based on sexual orientation. It states “The Plaintiffs are forced to choose between the risk of prosecution and foregoing access to any federal spousal protections. Once again, Wisconsin has no justification for this treatment other than Plaintiffs’ sexual orientation and sex.”
